It depends, as it is not a black-and-white situation. Generally speaking, if the divorce proceeding ends up with an award of maintenance ordered by the court, the asking side can in fact ask the court to award maintenance during the separation. However, if such award does not exist (no entitlement of maintenance), then the non-asking is not obligated to pay anything. On that basis, both sides should consider the potential outcome first. For example, if both sides are employed, there should be no expectation of maintenance. On the other hand, if either side is unemployed, then the employed side should be prepared to make such maintenance .

民法 第 1116-1 條 夫妻互負扶養之義務，其負扶養義務之順序與直系血親卑親屬同，其受扶 養權利之順序與直系血親尊親屬同。 第 1117 條 受扶養權利者，以不能維持生活而無謀生能力者為限。 前項無謀生能力之限制，於直系血親尊親屬，不適用之。
